Das Fehlen derartiger Urteile d\u00fcrfte daran liegen, dass sich die Problematik mangelnder Bautr\u00e4gerinformationen regelm\u00e4\u00dfig in den Bautr\u00e4gervertrag selbst verlagert. Denn Bautr\u00e4ger behalten sich im Bautr\u00e4gervertrag regelm\u00e4\u00dfig das Recht vor, den Leistungsgegenstand einseitig, z.B. gem\u00e4\u00df \u00a7 315 ff BGB, zu \u00e4ndern. Sie machen dann von der \u00c4nderungsbefugnis Gebrauch, ohne den K\u00e4ufer \u00fcber die beabsichtigten \u00c4nderungen vorab zu informieren. Die unterlassene Information des K\u00e4ufers wird im Bautr\u00e4gervertrag aber nur dann relevant, wenn die \u00c4nderungsklausel ausnahmsweise nicht ohnehin, n\u00e4mlich wegen Versto\u00dfes gegen \u00a7 308 Ziff. 4. BGB, unwirksam ist.
